Welcome to EnateHomeschool.com (the “Site”). By accessing or using the Site and its services, you agree to be bound by these Terms of Use (“Terms”). These Terms form a legally binding agreement between you and Enate Homeschool (“Enate”, “we”, “us”, or “our”). If you do not agree with any part of these Terms, you must not use the Site or services.

By using the Site on behalf of an organization or as a parent/guardian for a child, you represent that you have the authority to accept these Terms on behalf of that organization or as the responsible adult. If you do not have such authority or do not agree to these Terms, you should not use the Site.

2. Description of Services

Enate Homeschool provides an online platform and related tools designed to assist with home education. Our services (the “Services”) include:

  • AI Chatbot: An artificial intelligence chatbot that can answer questions, provide educational content, and assist in developing curriculum plans.
  • Evolving Curriculum Materials: Educational materials and curriculum content that update and improve over time, tailored to users' needs and inputs.
  • Educator Dashboard: A dashboard for parents and educators to track progress, manage curriculum, and adjust learning plans.

Our Services are primarily intended for use by parents or legal guardians (and educators) to support student learning at home. The Site is not intended for direct use by students or children without adult supervision. Features and content may evolve or change as we improve our offerings.

By using the Services, you acknowledge that the AI chatbot's responses are generated by machine learning algorithms. The content provided by the AI or within curriculum materials is for educational assistance and should not be your sole source for critical decisions. Always use discretion and verify important information independently.

3. Account Registration and Eligibility

Account Creation: To access most features of our platform, you must create an account. When registering, you agree to provide true, accurate, and complete information (such as your name and a valid email address) and to keep this information updated. Each user must have their own account; you should not share account credentials with others.

Age and Parental Responsibility: By creating an account, you affirm that you are at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into this agreement. The Services are intended for adults (parents, guardians, or educators) and not for use directly by minors. If you are a parent or guardian creating an account to use the Services for the benefit of a minor child, you take full responsibility for that child's use of the Site and Services. You agree to supervise the child's use and ensure compliance with these Terms.

Account Security: You are responsible for maintaining the confidentiality of your account login credentials. You must notify us immediately at support@enatehomeschool.com if you suspect any unauthorized use of your account or any other breach of security. Enate Homeschool will not be liable for any loss or damage arising from your failure to safeguard your account information, and you may be held liable for losses incurred by Enate or others due to such unauthorized use.

4. Paid Services and Subscription (“Plus” Mode)

Some features of Enate Homeschool are offered for free, while certain premium features are available through a paid subscription, referred to as Enate Homeschool Plus (“Plus”). By subscribing to Plus or making any payment on the Site, you agree to the following terms:

4.1 Subscription Features

Plus may include enhanced AI chatbot capabilities, additional curriculum content, advanced dashboard features, or other exclusive tools and resources. Details of current Plus features and pricing are provided on the Site. Enate reserves the right to add, modify, or remove features of the subscription service at any time, and will endeavor to inform subscribers of significant changes.

4.2 Fees and Payment

When you sign up for Plus, you agree to pay the subscription fees indicated for that service. Prices are stated in U.S. dollars (unless otherwise specified) and are exclusive of any taxes or duties that may apply in your jurisdiction. You will provide a valid payment method (such as a credit card) and authorize Enate or its payment processor to charge the subscription fee to that payment method. If your payment method fails or your account is past due, we may suspend or revoke your access to paid features until payment is received.

4.3 Billing Cycle and Auto-Renewal

Plus subscriptions are generally billed on a recurring basis (e.g., monthly or annually, depending on the plan you choose). Auto-Renewal: By default, subscriptions will automatically renew at the end of each billing cycle at the then-current price. You will be charged on each renewal date unless you cancel beforehand. We will indicate during sign-up whether your subscription will auto-renew, and you can manage or cancel the auto-renewal through your account settings at any time.

4.4 Cancellation

You may cancel your Plus subscription at any time through your account settings or by contacting customer support. Cancellation will take effect at the end of your current paid term. You will continue to have access to Plus features until the end of the billing period that you've paid for. No Pro-Rated Refunds: Unless required by law or explicitly stated otherwise, we do not provide partial or pro-rated refunds for unused portions of your subscription period. For example, if you cancel in the middle of a month, you will not typically receive a refund for the remaining days.

4.5 Changes to Fees

Enate Homeschool may change the subscription fees or introduce new fees for certain features in the future. If we do so, and you are a current subscriber, we will provide advance notice (for example, by email or a notice on the Site) of the fee change. Fee changes will apply at the start of the next billing cycle following the notice. If you do not agree to the new fees, you must cancel your subscription before the new fees take effect. Your continued use of Plus after the price change goes into effect constitutes your agreement to pay the updated amount.

4.6 Free Trials and Promotions

Enate may occasionally offer free trial periods or promotional offers for Plus. Such offers are subject to these Terms as well. We reserve the right to modify or terminate any free trial or promotion at any time, and to charge you for Plus if you do not cancel before the trial period ends (we will notify you of this when you sign up for the trial, if applicable).

5. User Conduct and Acceptable Use

We aim to foster a positive, safe, and productive environment for all users. By using our Services, you agree to the following rules of conduct:

  • Lawful Purposes: You will use the Site and Services only for lawful purposes. You may not use Enate Homeschool to violate any local, state, national, or international law or regulation.
  • Respectful Interaction: If the platform allows any form of interaction or content sharing, you will not post or transmit any content that is harmful, threatening, defamatory, obscene, harassing, or otherwise objectionable. Hate speech, bullying, or targeting others for any form of discrimination is strictly prohibited.
  • No Exploitation of the AI: You agree not to use the AI chatbot in ways that could cause harm. This includes not attempting to generate highly inappropriate, violent, or sexually explicit content, and not using the chatbot to facilitate illegal activities (such as creating malicious code or planning wrongdoing). You also agree not to try to trick or manipulate the AI into breaking rules that it is designed to follow.
  • Intellectual Property Respect: Do not submit or share content that you do not have the right to use. This means you won't upload, input, or transmit any material that infringes the copyright, trademark, trade secret, or other intellectual property or privacy rights of any party. If you include materials (like text or images) that are copyrighted by others, you must have permission or legal right to use them.
  • No Spam or Malicious Activity: You will not use the Service to distribute unsolicited promotional or commercial content (spam). You will not engage in activities that could harm the Site or Services, such as introducing viruses, worms, malware, or any code of a destructive nature. Attempting to probe, scan, or test the vulnerability of our systems or to breach security or authentication measures is prohibited.
  • Account Integrity: You will not impersonate any person or entity, or misrepresent your affiliation with a person or entity. You will not attempt to access accounts that are not yours or mislead others as to the origin of your communications.
  • Restricted Access and Monitoring: You agree not to access (or attempt to access) any part of the Site or Service by any means other than the interface provided by Enate. Using automated means (such as bots, scrapers, or scripts) to access or use the Services, or to extract data, is not allowed except as we may expressly permit in writing. We reserve the right (but have no obligation) to monitor any user's use of the Services to ensure compliance with these Terms.

User Responsibility: You are solely responsible for any content or data you input into the Site (including interactions with the AI chatbot) and any outcomes that result from your use of the information provided by our Services. Enate Homeschool is not responsible for how you apply the information or content obtained through the platform. If you misuse the Services or violate these rules, we may suspend or terminate your access (see Termination below), and if your conduct is unlawful, we may report it to the authorities.

6. User Content and Data Usage

Enate Homeschool is designed to personalize education, which means we collect and use information you provide to tailor the experience. This section explains how we handle the content and data you input:

6.1 User Content

User Content means any information or material that you provide to the Site or Services, including but not limited to: questions or messages you enter into the AI chatbot, profile information, curriculum preferences, feedback, and any other data you submit. You retain ownership of your User Content. Enate does not claim ownership over the content you provide. However, by submitting User Content, you grant Enate Homeschool a broad license to use it as described below.

6.2 License Grant to Enate

You hereby grant Enate Homeschool a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, adapt, modify, translate, create derivative works from, and display your User Content for the purposes of:

  • Providing and operating the Services (for example, processing your queries through the AI chatbot and generating appropriate responses).
  • Maintaining and improving the AI, curriculum materials, and platform features (this may include using your inputs to train or fine-tune algorithms and to develop new educational resources).
  • Ensuring safety and security, including monitoring for and preventing misuse of the platform or inappropriate content.
  • Normal usage analytics, such as aggregating usage data to understand how users interact with the Site, which helps us enhance performance and user experience.
  • Promotional purposes: Enate may use excerpts or summaries of user success stories, feedback, or interactions in an anonymized or de-identified form for marketing and promotional materials.

6.3 Data Retention

You understand that content you provide (such as chatbot conversations or data in your dashboard) may be retained by Enate Homeschool. Even if you delete specific messages or delete your account, copies of your data might remain in our backup systems or archived databases for a period of time consistent with our data retention practices.

6.4 Personal Information and Privacy

If you provide personal information, we will handle that information in accordance with our Privacy Policy. By using the Site, you consent to the collection and use of information as outlined in these Terms and our Privacy Policy.

6.5 Third-Party Service Providers

To deliver our Services effectively, we utilize third-party services and APIs. Notably, our AI chatbot functionality may rely on external artificial intelligence providers such as OpenAI. This means that when you input text or questions into the chatbot, your input may be sent to OpenAI's servers (or similar AI service providers) to generate a response.

The Site and Services may include references or links to third-party websites or resources for your convenience. These third-party sites and services are not under Enate Homeschool's control, and their inclusion does not imply endorsement or an association with us.

8. Intellectual Property Rights

Enate Homeschool reserves the right to suspend or terminate your account or access to the Services immediately, without prior notice or liability, if we determine that you have violated these Terms or any applicable law.
